ORDER OF COURT
AND NOW, this 16th day of March 2020, consistent with the Order of
the Supreme Court of Pennsylvania dated March 16, 2020, this Court declares
a judicial emergency in the Fifth Judicial District of Pennsylvania. The Court
orders the following actions be taken pursuant to Pa.R.J.A. No.1952(B)(2):
All time calculations for the purposes of time computation relevant to
court cases or other judicial business, as well as time deadlines, are
suspended subject to constitutional restrictions.
Additional uses of advanced communication technology to conduct court
proceedings, is authorized subject to constitutional restrictions.
All provisions of this Order apply to cases scheduled from March 17,
2020 through April 14, 2020.
Civil Division
Jury trials are suspended pending further Order of Court and non-jury
trials may be suspended on a case by case basis.
General Motions heard by the General Motions Judge shall be restricted
to Petitions for Injunctive Relief relating to public health concerns such
as taking of residential property, ejectment, eviction and/or other public
health issue/concern involving immediate and irreparable harm, or any
other Emergency Motion.
Housing Court Motions shall be restricted to Emergency Motions relating
to matters involving public health concerns, including but not limited to
evictions, addressing suspension of utilities, and or other habitability
issues involving public health concerns.
There will be no Friday afternoon Discovery Motions.
Arbitration Hearings shall be rescheduled by the arbitration department
staff; such matters will generally be scheduled during the months of July
and August 2020. Parties not satisfied with the newly scheduled date
can seek an alternative date by motion presented to the Calendar
Control Judge.
Landlord/Tenant Arbitration Hearings will be rescheduled by the
arbitration department staff. Parties not satisfied with the newly
scheduled date may seek an alternative date by motion presented to
the Housing Court Judge.
Hearings before the Board of Viewers shall be rescheduled by the Board
of Viewers staff.
Litigants with Consented-to-Motions may drop off such Motions at the
Desk/Table inside of Courtroom 703 in the inbox marked “General
Motions Consented-to-Motions.”
Any Motion dropped off in the Consented-to-Motions inbox, must be
accompanied by an Affidavit signed by one of the two parties, or the
parties’ lawyer(s) stating therein that the other side has (i) Seen the
Motion at issue and (ii) Consents to, or does not oppose, the Motion and
the proposed Order of Court attached to the Motion.
In any case specially assigned to a Judge, all inquiries regarding
currently scheduled proceedings should be addressed with that Judge.
Criminal Division
All court events, except as indicated below, in each of the criminal
division courtrooms will be postponed. Courtroom staff will notify all
litigants prior to their scheduled events and propose a continuance date
acceptable to all parties.
Summary and statutory appeals normally heard in room 821 of the City
County Building will be postponed.
Bail hearings and daily motions court will be heard as normal.
The motions counter in room 534 will remain open for emergency
motions and a warrant clerk will be on duty to lift and issue warrants as
per Court’s directive.
Defendants who wish to turn themselves in on bench warrants to Pretrial
Services may continue to do so.
Pretrial conferences and formal arraignments will be rescheduled.
Family Division
Adult Section

Juvenile Delinquency
Scheduled conferences and hearings in support, custody, equitable
distribution, and divorce will be postponed.
Emergency motions and bench warrant hearings will be heard.
Protection from Abuse matters will be heard as normal.
Juvenile delinquency matters shall be handled on a case by case basis.
Parties should appear for all juvenile delinquency matters scheduled
before the Court, unless otherwise notified.

Juvenile Dependency
Juvenile dependency matters shall be handled on a case by case basis.
Parties should appear for all juvenile dependency matters scheduled
before the Court, unless otherwise notified.
The Court shall continue to handle shelter care proceedings, pursuant
to Pa. C.S. 6332.
The Court shall continue to issue orders for protective custody, pursuant
to Pa. R.J.C.P. Rule 1210.
The Court shall continue to be available to issue orders for Authorization
for Medical Treatment of a Minor, pursuant to 18 Pa. C.P.S.3201.
Orphans’ Court Division
Conferences and hearings will be conducted as scheduled.
Motions will continue to be heard daily at 9:30 a.m.
Involuntary civil commitment hearings will continue as scheduled at the
twelve hospital/health care facility hearing sites.
Any litigant and/or attorney seeking a continuance should contact the
chambers of the assigned judge.
The next scheduled termination/adoption list will be called on March 25-
26, 2020. These cases will be staggered to avoid overcrowding of the
courtroom.

All cases in the Magisterial District Courts are postponed.
Execution of Orders for eviction or possession of residential properties
in Allegheny County are stayed.
All time calculations relevant to Magisterial District Court proceedings
located in the Pennsylvania Rules of Conduct, Office Standards for Civil
Procedure for Magisterial District Judges and the Pennsylvania Rules of
Criminal Procedure shall be suspended.
The Magisterial District Courts shall operate in accordance with the
Magisterial District Courts’ COVID-19 Plan. Eight Magisterial District
Courts and Pittsburgh Municipal Court Arraignment Division will remain
open to the public for designated operations. All other Magisterial
District Courts will be closed to the public. See attached MDC COVID-
19 plan.

petitions.
