REPLY TO PETITION FOR EMERGENCY JUDICIAL ORDER 

NOW COMES, the Commonwealth of Pennsylvania, by Albert C. Ondrey, Esq., District 

Attorney of Bradford County, and respectfully submits as follows: 

1.  On October 4, 2021, President Judge Beirne filed a Petition for Emergency Judicial Order 

Pursuant to Pa.R.J.A. No. 1952(B)(2), requesting this Honorable Court to suspend 

application of Pennsylvania Rule of Criminal Procedure Rule 600 through December 31, 

2021. 

2.  The basis for the request is due to a significant increase in COVID-19 positive cases at 

the Bradford County Correctional Facility. 

3.  The Commonwealth joins President Judge Beirne's request to suspend Rule 600 through 

December 31, 2021 for all the reasons stated in the October 4, 2021 Petition, most 

important of which is to mitigate the threat of spreading the COVID-19 virus to inmates, 

BCCF staff, Sheriffs Deputies, courthouse staff, attorneys, witnesses, and jurors. 

WHEREFORE, the Commonwealth respectfully submits President Judge Beirne's 

request to suspend Rule 600 through December 31, 2021 should be granted.
